In this article, an intervention aimed at improving quality of care to prevent seclusion in psychiatry by focusing on the first five minutes at admission is analyzed from a care ethics perspective. Two cases are presented from an evaluation study in a psychiatric hospital. In both cases, the nurses follow the intervention protocol, but the outcome is different. In the first case, the patient ends up in the seclusion room. In the second case, this does not happen. Analyzing the cases (...) from a care ethics perspective, we conclude that applying the intervention in the right way implies more than following the steps laid down in the protocol. It requires a new way of thinking and acting, resulting in new relationships between nurses and patients. Care ethics theory can help clarify what good care is actually about and keep in mind what is needed to apply the intervention. Thus, care ethics theory can be highly practical and helpful in changing and improving healthcare practice. (shrink)

As emerging technologies support new ways in which people relate, ethical discourse is important to help guide designers of new technologies. This article endeavors to do just that by presenting an ethical analysis and design of technology intended to gather and act upon information on behalf of its users. The article elaborates on socio-technological factors that affect the development of technology to support ethical action. Research and practice implications are outlined.

In recent years, “deliberation” has become the byword of many political theorists, most of whom identify deliberation with reasoned conversation. Among the most forceful advocates of deliberation as conversation are Jürgen Habermas and, to a greater or lesser extent, his successors who style themselves “deliberative democrats.” For them, the more political decision‐making approximates the ideal of a reasoned public conversation among free and equal individuals, the more legitimate and rational it will be. “Outcomes,” they say are democratically legitimate if and (...) only if they could be the object of a free and reasoned agreement among equals. Dialectic, as commonly approached, is not an analytic study, as the notion is defined in the paper. Where it is analytically approached, the result is pragmatic in nature, as well as syntactic and semantic. This paper lays the foundations of a purely formal analysis of conversations. This study is accordingly called "Conversation Theory". The key notions of "conversation", "dialogue", "conversation game", "rules of response", "epistemic community" and "channel of informations" are defined precisely, and an analysis of how these notions fit (...) together is given. Particular attention is given to distinguishing conversation theory from standard logic. This is a study of how self-transformation may occur through the practice of reframing one's personal experience in terms of a canonical language: that is, a system of symbols that purports to explain something about human beings and the universe they live in. The Christian conversion narrative is used as the primary example here, but the approach used in this book also illuminates other practices such as psychotherapy in which people deal with emotional conflict through language.

This paper outlines a first attempt to model the special constraints that arise in language processing in conversation, and to explore the implications such functional considerations may have on language typology and language change. In particular, we focus on processing pressures imposed by conversational turn-taking and their consequences for the cultural evolution of the structural properties of language. We present an agent-based model of cultural evolution where agents take turns at talk in conversation. When the start of planning for the (...) next turn is constrained by the position of the verb, the stable distribution of dominant word orders across languages evolves to match the actual distribution reasonably well. Upshot: This commentary will address the implicit and explicit connections between Banathy’s Conversation Methodology, which is the heart of the process used at the IFSR Conversations held every two years in Austria, and constructivist theories in application.

I outline and motivate a way of implementing a closest world theory of indicatives, appealing to Stalnaker's framework of open conversational possibilities. Stalnakerian conversational dynamics helps us resolve two outstanding puzzles for a such a theory of indicative conditionals. The first puzzle -- concerning so-called 'reverse Sobel sequences' -- can be resolved by conversation dynamics in a theoryneutral way: the explanation works as much for Lewisian counterfactuals as for the account of indicatives developed here. Resolving the second puzzle, by contrast, (...) relies on the interplay between the particular theory of indicative conditionals developed here and Stalnakerian dynamics. Anecdotal evidence suggests that participants in conversation can sometimes act as a coalition. This implies a level of conversational organization in which groups of individuals form a coherent unit. This paper investigates the implications of this phenomenon for psycholinguistic and semantic models of shared context in dialog. We present a corpus study of multiparty dialog which shows that, in certain circumstances, people with different levels of overt involvement in a conversation, that is, one responding and one not, can nonetheless access (...) the same shared context. We argue that contemporary models of shared context need to be adapted to capture this situation. To address this, we propose “grounding by proxy,” in which one person can respond on behalf of another, as a simple mechanism by which shared context can accumulate for a coalition as a whole. We explore this hypothesis experimentally by investigating how people in a task-oriented coalition respond when their shared context appears to be weakened. The results provide evidence that, by default, coalition members act on each other's behalf, and when this fails they work to compensate. We conclude that this points to the need for a new concept of collective grounding acts and a corresponding concept of collective contexts in psycholinguistic and semantic models of dialog. (shrink)

Legal texts are often given interpretations that deviate from their literal meanings. While legal concerns often motivate these interpretations, others can be traced to linguistic phenomena. This paper argues that systematicities of language usage, captured by certain theories of conversational implicature, can sometimes explain why the meanings given to legal texts by judges differ from the literal meanings of the texts. Paul Grice's account of conversational implicature is controversial, and scholars have offered a variety of ways to conceptualize implicatures and (...) Grice's maxims of conversation. Approaches that emphasize the systematic nature of implicatures can provide explanatory accounts of the gap between literal meaning and the meaning communicated in the text. For example, a theory of scalar implicature, a type of generalized conversational implicature, can account for the application of the interpretive principle known as ejusdem generis, which narrows the scope of “catch-all” clauses located at the end of lists of items. Despite the availability of such theories, some scholars have argued that conversational implicatures are not applicable to legislation. The arguments, based primarily on the uniqueness of the legislative context and its noncooperative nature, though, do not establish the inapplicability of conversational implicatures to legislation. Juan Huarte de San Juan (1529–88) was a physician of the Spanish Renaissance. He wrote the Examen de Ingenios para las Ciencias, translated as The Trial of Men’s Wits (1989[1575–94]), a book that has been acknowledged as a precursor of educational psychology, organizational psychology, behaviorism, neuropsychology and psychiatry. Huarte suggested that before beginning a course of study, students’ intellectual capabilities (i.e. ingenio) should be matched up with the professional studies that best suit their aptitudes. His book had a great impact (...) in Europe from the late 16th century to the mid-18th century. The influence of the Trial spread throughout many areas including philosophy, politics, linguistics and literature. Although there has been a growing interest in Huarte’s work in recent years, biographical studies have been rare; as a result, the information about Huarte’s life is currently incomplete, scattered and sometimes inaccurate. This study presents a systematic archival research on Spanish original sources. We present a reconstruction of Huarte’s life-story based on 32 original documents (1549–c.1650), some of them first discovered during the present survey. Documents are described according to the General International Standard of Archival Description, ISAD(G). The documents uncovered allow for a reappraisal of Huarte’s biography. (shrink)

Conducting “difficult conversations” with patients and caregivers is one of the most difficult aspects of the medical profession. These conversations can involve communicating a terminal prognosis, advance care planning, or changing the goals of treatment. Although they are challenging, the need for these conversations is underwritten by the tenets of medical ethics. Unfortunately, medical professionals lack adequate training in communication skills and overestimate their abilities in conducting difficult conversations. I suggest that one way to improve that ability would be the (...) strategic use of pharmaceutical neuroenhancements. Pharmaceutically augmenting a professional’s capacity for recognizing masked emotional expressions might conduce to his or her development of open and responsive communication with patients and caregivers. I conclude by examining the limitations and objections to this use of a communication enhancement by illustrating that it would still require the development of, and indeed a greater emphasis on, communication skills in medical education and training. In this article we present the bases for a computational theory of the cognitive processes underlying human communication. The core of the article is devoted to the analysis of the phases in which the process of comprehension of a communicative act can be logically divided: (1) literal meaning, where the reconstruction of the mental states literally expressed by the actor takes place: (2) speaker's meaning, where the partner reconstructs the communicative intentions of the actor; (3) communicative effect, where the partner (...) possibly modifies his own beliefs and intentions; (4) reaction, where the intentions for the generation of the response are produced; and (5) response, where an overt response is constructed. The model appears to be compatible with relevant facts about human behavior. Our hypothesis is that, through communication, an actor tries to exploit the motivational structures of a partner so that the desired goal is generated. A second point is that social behavior requires that cooperation be maintained at some level. In the case of communication, cooperation is, in general, pursued even when the partner does not adhere to the actor's goals, and therefore no cooperation occurs at the behavioral level. This important distinction is reflected in the two kinds of game we introduce to account for communication. The main concept implied in communication is that two agents overtly reach a situation of shared mental states. Our model deals with sharedness through two primitives: shared beliefs and communicative intentions. (shrink)

This paper provides new elements for reconstructing Heinrich Hertz's conversion from an electrodynamic concept to a concept of field theory, a process that took place between September 1887 and February 1888. First of all, it is argued that, contrary to what one could deduce from Hertz's own presentation in his Untersuchungen (or Electric Waves), paper N∘ 5 was actually written after the first publication of papers N∘ 6 and N∘ 7; this fact is illuminated by Hertz's unpublished correspondence (Section 1). (...) Following this reordering, an approximative process of Hertz's conversion based only on his published papers is described (Section 2). Second, by complementing Hertz's published Erinnerungen (or Memoirs, Letters, Diaries) with his unpublished Versuchsprotokolle (Laboratory notes), a much finer description of this conversion process is discussed (Section 3). It is finally concluded that Hertz's idea of “air waves” belongs at the very end of this process, and was mainly attained through experimental hints found within Helmholtz's theoretical framework. We seek to change the conversation about brain death by highlighting the distinction between brain death as a biological concept versus brain death as a legal status. The fact that brain death does not cohere with any biologically plausible definition of death has been known for decades. Nevertheless, this fact has not threatened the acceptance of brain death as a legal status that permits individuals to be treated as if they are dead. The similarities between “legally dead” and “legally blind” (...) demonstrate how we may legitimately choose bright-line legal definitions that do not cohere with biological reality. Not only does this distinction bring conceptual coherence to the conversation about brain death, but it has practical implications as well. Once brain death is recognized as a social construction not grounded in biological reality, we create the possibility of changing the social construction in ways that may better serve both organ donors and recipients alike. This article builds on my previous article on Dirk H. Th. Vollenhoven (Ive 2015) and provides an overview of the development of the systematic philosophy of Herman Dooyeweerd. This article seeks to provide an overview of the key developments in the thinking of Dooyeweerd, both in the convergences arising from the conversation of the two brothers-in-law and long-term colleagues and in their divergences. Dooyeweerd and Vollenhoven worked within the tradition of Abraham Kuyper, the father of Reformational philosophy. The development of (...) their respective philosophical systematics has tended to be addressed separately. However, I argue that the close cooperation between the two philosophers was critical in the formulation of the philosophy of the cosmonomic Idea. The philosophical conversation between the two persisted, despite critical divergences, largely aired privately. Their respective insights remained a source of mutual stimulus and complementarity foundational for Reformational philosophy. (shrink)

This paper criticizes the understanding of philosophy as entirely made up of argument. It gives some characterization of argument as a rhetorical form and conversation as a motivating attitude. It explicates the understanding of this distinction in Book 1 of Plato’s Republic, and emphasizes the contemporary relevance of the distinction by appeal to the work of Richard Rorty. While respectful of Rorty’s insights, it sides more with the Platonic understanding of philosophical conersation, which does not abandon the pursuit of truth.

Currently, patients are expected to take control over their health and their life and act as independent users and consumers. Simultaneously, health care policy demands patients are expected to self manage their disease. This article critically questions whether this is a realistic expectation. The paper presents the auto-ethnographic narrative of the first author, which spans a period of 27 years, from 1985 to 2012. In total nine episodes were extracted from various notes, conversations and discussions in an iterative process. Each (...) of these episodes was condensed around a ‘critical moment’ as perceived by the “self”. The critical moments in the illness process vary between newly encountered problems with basic needs and mourning, to renewed strength and the desire to grow, embracing new situations. Being confronted with and living with a chronic illness involves periods of anxiety and self centredness alternating with strength and advocating the interests of peer-patients. These episodes of emotion, confusion and refinding a balance have a cyclic pattern. The narrative illustrates the vulnerability and dependency of a patient with a chronic disease. The discussion relates this to mainstream dominant views on patients ‘in control of their own life’. The narrative illustrates, that the vulnerability and dependency of the patient are key factors to take into account in health care policy. The narrative provides a counter story, challenging current thinking in terms of strength, selfmanagement, patients’ own control and independent role. (shrink)

COVID-19 has stolen millions of lives and devastated livelihoods around the world and led to the exacerbation of existing inequities within and between countries. This part of a tragic pattern in catastrophes, where the most vulnerable populations are typically the ones to bear the greatest burdens. Jecker and Au1 offer a keen observation of how one particular COVID-19 response—Zero COVID—appears particularly problematic from a health equity perspective. Under Zero COVID, countries enact stringent lockdowns and movement restrictions in order to keep (...) cases as low as possible. Yet such restrictive policies hurt disadvantaged populations the most, by severely curtailing their ability to earn a living and forcing them to remain in cramped living spaces for potentially extended periods of time. However, the link between Zero COVID and health inequity is more complex than it might at first appear. This is because Zero COVID is itself compatible with meaningful efforts to mitigate inequities, including those caused by Zero COVID policies themselves. Advance care planning allows patients to articulate preferences for their medical treatment, lifestyle, and surrogate decision-makers in order to anticipate and mitigate their potential loss of decision-making capacity. Written advance directives are often emphasized in this regard. While these directives contain important information, there are several barriers to consider: veracity and accuracy of surrogate decision-makers in making choices consistent with the substituted judgement standard, state-to-state variability in regulations, literacy issues, lack of access to legal resources, lack of understanding of medical (...) options, and cultural disparities. Given these issues, it is vital to increase the use of patient and healthcare provider conversations as an advance care planning tool and to increase integration of such discourse into advance care planning policy as adjuncts and complements to written advance directives. This paper reviews current legislation about written advance directives and dissects how documentation of spoken interactions might be integrated and considered. We discuss specific institutional policy changes required to facilitate implementation. Finally, we explore the ethical issues surrounding the increased usage and recognition of clinician–patient conversations in advance care planning. (shrink)

It is known that the Restricted Predicate Calculus can be embedded in an elementary theory, the signature of which consists of exactly two equivalences. Some special models for the mentioned theory were constructed to prove this fact. Besides formal adequacy of these models, a question may be posed concerning their conceptual simplicity, "transparency" of interpretations they assigned to the two stated equivalences. In works known to us these interpretations are rather complex, and can be called "technical", serving only the purpose (...) of embedding. We propose a conversion method, which transforms an arbitrary model of RPC into some model of the elementary theory TR, which includes three equivalences. RPC is embeddable in TR, and it appears possible to assign some "natural" interpretations to three equivalences using the "Track of Relation " concept. (shrink)
